Health care organizations develop operational policies and procedures that not only meet the organization’s purpose and mission but that are also compliant with state and federal regulations. This week differences between a law and policy are investigated. We will investigate how a policy is developed from regulations, which are based on a specific law(s) designed to protect confidentiality and secure protected health information (PHI).

Here, you want to explain how the law is regulated. For example, HIPAA is regulated by the Department of Health and Human Services, specifically the Office of Civil Rights (OCR). HIPAA requires covered entities to comply with the Security Rule, and the OCR is responsible for enforcing the Security Rule. You should list the potential fines/penalties associated with a violation of HIPAA. Please be sure to include citations to give credit to your sources (Zubich, 2022). Also, please be sure to have a minimum of 45 words here.

Here, you want to explain how the policy is regulated. For example, Home Health Agency Policies are regulated through state and federal regulatory certifications. Ultimately, the state that the Home Health Agency resides in is the surveying entity. All policies should be set based on both the state and federal regulations set for home health care. Please include an example of potential fines/penalties if a Home Health Agency does not adhere to the regulatory requirements set by the state and federal regulatory bodies.
